This privacy policy (the “Privacy Policy”) provides you with information regarding how the Company collects, uses, and discloses information relating to individuals who visit our website, use our proprietary APIs and services (collectively, "Services"), or whose information is included in the business contact data provided through our API.
The Company's Services are at all times subject to the Terms of Service, which incorporates this Privacy Policy. Any undefined terms used in this Privacy Policy have definitions given to them in the Terms of Service.
The Company reserves the right to change or modify this Privacy Policy in our sole discretion at any time. 2. INFORMATION WE COLLECT
We collect or process two main categories of information:
2.1 Information Collected From Our API Users (Customers)
This data is collected directly when you register for an API key, sign up for a demo, or contact support:
- Identifiers & Contact Data: Name, business email address, phone number, job title, and company affiliation.
- Billing Information: Payment information, billing address, and transaction details (processed via secure third-party payment providers).
- Usage & Technical Data: API usage logs, IP addresses, request/response timestamps, browser type, device information, and diagnostic data related to service performance.
2.2 Business Contact Data (Third-Party Data Subjects)
Our core service involves the processing and delivery of B2B lead and market intelligence data. This data is professional and business-oriented and generally includes:
- Professional Identifiers: Name, current job title, company name, and department.
- Professional Contact Information: Business email address, business phone number, and professional social media profile URL (e.g., LinkedIn).
- Company Details: Industry, company size, revenue, and location.
2.3 Sources of Business Contact Data
We obtain this Third-Party Data through several methods:
- Publicly Available Sources: Information collected from publicly accessible websites, professional directories, and government registries.
- Third-Party Data Providers: Data acquired from trusted partners and vendors who maintain high standards of data hygiene and compliance.
- Proprietary Research: Information gathered by our internal research teams through proprietary collection and verification methods.
3. HOW WE USE YOUR INFORMATION
We use the information we collect for the following purposes:
3.1 For API Users (Our Customers)
- Service Provision: To provide, operate, and maintain the Datpaq API Services and access to the requested data.
- Billing and Support: To process payments, manage your account, and provide technical and customer support.
- Improvement: To monitor usage, analyze trends, and improve the API's performance, reliability, and functionality.

3.2 For Third-Party Data Subjects
- Core Business Purpose: The sole purpose is to provide our enterprise clients with verified, current, professional contact data for legitimate business use, such as market research, recruiting, and B2B sales outreach.
4. DATA SHARING AND DISCLOSURE (Liability Mitigation)
We do not sell personal information to third parties. We only share data in the following circumstances:
4.1 Customer Compliance Obligations
The Customer (API User) acts as the Data Controller for the data they retrieve. The Customer is solely responsible for ensuring its collection, storage, and processing of data, including obtaining all necessary consents, is compliant with all applicable laws (e.g., CAN-SPAM, TCPA, GDPR, CCPA).
4.2 Indemnification and Liability
By using our Services, Customers agree to the indemnification and liability provisions set forth in our Terms of Service. These provisions protect Datpaq API LLC from any legal claims, damages, or liabilities arising from the Customer's non-compliant or misuse of the data provided by the API.
4.3 Right to Audit and Terminate
We reserve the right, upon reasonable notice, to monitor or audit Customer API usage and require evidence of compliance with applicable laws. We may immediately suspend or terminate access to the Services, without liability to the Customer, upon reasonable suspicion of non-compliance with data protection laws or our Terms of Service.
4.4 With Customers (API Data)
The business contact data we provide via the API is licensed to our customers for their defined internal business use. Datpaq API LLC is merely the Data Processor regarding the data retrieved by the Customer.
4.5 Service Providers
We share data with third-party vendors, consultants, and service providers (e.g., payment processors, hosting providers, analytics firms) who require access to perform services on our behalf and are bound by confidentiality obligations.
4.6 Legal Compliance
If required by law, subpoena, court order, or governmental regulation, or to protect the property, rights, or safety of the Company, our customers, or the public.
4.7 Business Transfers
In connection with a merger, acquisition, sale of assets, or bankruptcy, provided the recipient agrees to abide by this Policy.
4.8 Affiliates
With entities within the Datpaq corporate family, provided such affiliates comply with this Policy.
5. YOUR PRIVACY RIGHTS AND CHOICES (Enforcement)
Depending on your location, you may have the right to Access, Rectification, Erasure,Object, Know, Delete, and Opt-Out regarding your personal information.
5.1 How to Exercise Your Rights
You may exercise your rights by contacting our Data Protection Officer (DPO) using the contact details in Section 7.
5.2 Pass-Through Obligation (Data Controller/Processor Role)
In cases where a Third-Party Data Subject submits a data rights request (e.g., deletion) related to data obtained via the API, Datpaq API LLC shall notify the relevant Customer (Data Controller) of the request and rely on the Customer to fulfill that request in compliance with their legal obligations.
5.3 Data Subject Redress against Customers
For questions, objections, or requests regarding the specific use of your data in a customer's product or service, we recommend Data Subjects contact the Datpaq Customer (the Data Controller) directly for the most direct and timely resolution.
6. DATA RETENTION AND SECURITY
6.1 Retention and Data Refresh
We retain data for as long as necessary to provide the Services and comply with legal obligations. If a Data Subject exercises their right to object or requests deletion, the data will be removed from Datpaq's active API datasets within thirty (30) days and will not be provided to new Customers. Data is periodically validated, refreshed, and removed if found to be inaccurate or outdated.
6.2 Security Measures
We use appropriate physical, electronic, and procedural safeguards (such as encryption, strict access control, and network security) to protect the information we collect and maintain. These measures are applied equally to API User Data and the Third-Party Business Contact Data within our API datasets. However, no security system is impenetrable, and we cannot guarantee 100% security.
